Terms & Conditions for Toilets By Gaia

1. Introduction
These Terms & Conditions (“Terms”) govern the hire of portable toilet units (“Units”) by Toilets By Gaia (“we”, “us”, “our”) to you, the hirer (“you”, “your”). By booking or paying for our services, you agree to be bound by these Terms.

2. Definitions

  • “Hire Period” means the period from delivery of the Unit to its off‑hire and collection.

  • “Delivery Date” means the date on which the Unit is delivered to your site.

  • “Off‑Hire” means the date on which you request collection of the Unit.

  • “Site” means the location where the Unit is delivered and used.

3. Clean & Safe Units

  • We undertake to deliver Units that are clean and in proper working order on the agreed Delivery Date.

  • All Units comply with applicable UK health, safety, and environmental regulations.

4. Servicing

  • Units are serviced on a weekly basis throughout the Hire Period.

  • You must ensure each Unit is accessible within 15 feet of a safe, level surface for our operatives.

  • If access is obstructed and servicing is missed, you may still incur the standard service charge for that week.

5. Damage, Loss & Misuse

  • You are responsible for any damage to or loss of the Unit from the time of delivery until collection.

  • Charges for repair or replacement will be invoiced at our standard rates.

  • You must not move, modify, paint, or sub‑let the Unit without our prior written consent.

6. Delivery & Collection

  • You must provide and maintain clear, safe access for our delivery and collection vehicles.

  • Collection may take up to 5 working days following your Off‑Hire request.

  • Any delay caused by insufficient access or failure to request Off‑Hire properly may incur additional hire charges.

7. Payment Terms

  • Payment of the hire charges and any applicable deposit is due on or before the Delivery Date, unless otherwise agreed in writing.

  • Late payments will incur interest at 4% above the Bank of England base rate, compounded daily, plus any reasonable debt‑recovery costs.

  • We reserve the right to suspend or remove Units if payment is overdue.

8. Liability & Force Majeure

  • We shall not be liable for any indirect, consequential, or special loss, including loss of profits, arising from hire or use of the Units.

  • We are not responsible for damage to property or personal injury caused by your negligence, misuse of the Unit, or events beyond our control (e.g., weather, traffic congestion, strikes).

  • In the event of a force majeure (e.g., natural disaster, pandemic, road closures), we will endeavour to minimise disruption but accept no liability for delays.

9. Off‑Hire & Cancellations

  • To Off‑Hire, you must call or email us; verbal requests alone are not sufficient.

  • Cancellation made within 20 days prior to the agreed Delivery Date may incur a cancellation fee up to the full hire charge for the scheduled Hire Period.

  • Any deposit paid is non‑refundable.

10. Site Permissions & Responsibilities

  • You are responsible for obtaining all necessary permissions, licenses, or consents for placing and using Units on your Site.

  • Units must be protected from frost, extreme weather, and vandalism. Any additional site protection required is your responsibility.

11. Data Protection & Privacy

  • Any personal data you provide (e.g., via our contact form) will be processed in accordance with our Privacy Policy, available at [your-website]/privacy-policy.

12. Governing Law

  • These Terms are governed by and construed in accordance with the laws of England and Wales.

  • Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.

By booking or making payment for our Units, you acknowledge that you have read, understood, and agree to these Terms & Conditions in full.
